Terms of Service
1. Scope and Nature of Services
medicalfly acts solely as an intermediary for transportation and organizational services, including travel bookings, hotel reservations, and the arrangement of appointments with clinics and physicians. The agreement between you and medicalfly constitutes an agreement with a medical tourism intermediary and is independent of any other agreements related to the purpose of your trip.
medicalfly is not a tour operator and assumes no obligation to provide the booked travel services itself. On your behalf and with your consent, medicalfly arranges individual agreements with necessary service providers such as travel agencies, airlines, hotels, and other entities suitable for the services and travel purpose requested by you. medicalfly’s role is limited to arranging these agreements.
Contracts for medical treatments are concluded directly between you and the clinic, hospital, or physician. medicalfly is not liable for any claims related to treatments performed by clinics, physicians, or hospitals, including claims arising from medical malpractice.
All surgeries, pre-operative and post-operative examinations, and all other medical services are provided exclusively by the clinics to which medicalfly refers patients. Information regarding prices, travel duration, and similar matters is based solely on information provided by the respective service providers. Failure by any contracting party to fulfill its obligations shall under no circumstances give rise to claims for damages or compensation against medicalfly.
The provision of the organized services does not form part of medicalfly’s contractual obligations. Therefore, medicalfly is not liable for the proper performance of services by its service providers.
2. Right of Withdrawal
In accordance with applicable legal regulations, medicalfly provides the following information regarding the right of withdrawal:
- As a general rule, the consumer has the right to withdraw from the contract within fourteen days without giving any reason. This period begins upon signing the contract.
- The withdrawal must be declared in writing or on a durable medium to the intermediary service provider before the withdrawal period expires.
- Contracts for services that begin before the expiry of the withdrawal period with the consumer’s consent are excluded from this rule. Since the organization of travel, flight tickets, accommodation, and reservations for doctors and operating rooms begins immediately upon signing the contract—and consultation services provided before signing are also included in the fees—the fee specified in Section 4 will be retained even if the right of withdrawal is exercised.
- If less than fourteen days remain between the signing of the contract and the scheduled surgery date, additional payments may be required, provided that they do not exceed the total contract value.
3. Additional Costs
The services listed in this contract do not include additional costs that may arise from services provided by airlines, hotels, clinics, hospitals, or physicians. Costs for additional examinations, analyses, prescribed medications, or optional but recommended treatments are not included in the medicalfly package and must be borne by the customer.
4. Reservation Changes and Cancellations
medicalfly charges the following fees for changes or cancellations:
- A processing fee of €50 for changes to hotel or flight bookings.
- A processing fee of €250 for rescheduling a surgery date within 30 days prior to the originally planned date.
- For cancellations made more than 30 days before the surgery date, a processing fee equal to 15% of the total surgery cost will be charged.
- For cancellations made within 30 days before the surgery date, a processing fee equal to 30% of the total surgery cost will be charged.
- Additional costs may arise due to hotel, airline, or hospital policies regarding booking changes or cancellations. If flight, hotel, or clinic services have been booked on a binding basis, additional charges may be incurred due to cancellations, changes, or refunds imposed by the service provider, over which medicalfly has no control. These amounts cannot be deducted from payments made to medicalfly.
Cancellations must be submitted in writing by post or email. Any claims arising from cancellations or changes are the responsibility of the respective service provider. medicalfly neither has the legal authority nor the obligation to act as your representative in claims against such providers.

5. Cases Equivalent to Cancellation
The following situations shall be treated as cancellations:
- The customer fails to comply with the pre-operative requirements, resulting in the cancellation of the procedure.
- During the pre-operative examination, medical conditions are discovered that prevent the procedure from being performed.
- The customer does not agree to the treatment plan forming the basis of the travel organization upon arrival.
- The customer refuses to undergo the surgery on-site for any reason whatsoever.
Costs for pre-operative examinations, hospital stays, prescribed medications, treatments, or imaging procedures are billed directly by the hospital and must be paid by the customer.
6. Liability
In its role as an intermediary, medicalfly is liable only for the careful selection of service providers and the proper transmission of contractual information.
Information regarding flights, transfers, and hotel accommodations is based solely on information provided by the respective service providers. medicalfly accepts no liability for medical services, travel services, or accommodation in hotels or clinics, as these are governed by contracts concluded directly between the customer and the respective providers.
medicalfly assumes no liability for services that are not provided or are provided inadequately by service providers, nor for incidents such as theft or accidents occurring in clinics, hospitals, airlines, or accommodations.
7. Obligations Related to Travel/Airlines
Please read the terms and conditions of the service providers (particularly airlines) carefully. medicalfly is not responsible for transferring contractual obligations related to flights or travel to you.
8. Data Protection
The provision of your personal data to medicalfly is essential for conducting its business activities. In accordance with the GDPR and other applicable national and international regulations, your personal data will be securely stored by our company in digital or physical systems. You must review and approve our company’s Personal Data Protection Policy and the relevant information notice available at:
Following your review and approval, separate consent may also be requested in accordance with Turkish data protection legislation and related regulations.
9. Jurisdiction and Applicable Law
All legal disputes arising between medicalfly and the customer shall be subject exclusively to the courts of İzmir, Republic of Türkiye.
Turkish law shall apply to the resolution of such disputes.
